A lawsuit was recently filed under the First Amendment in Federal Court to challenge the Virginia alcohol law governing happy hours. The lawsuit was filed by the Chef Geoff’s restaurant and its owner. The Complaint claims that the Virginia law in question is an unconstitutional content-based restriction on speech by banning truthful speech and also that the law’s ban on “two for one” specials is a unconstitutional restriction on speech. The Commonwealth of Virginia has not filed its answer yet.
